The two people who testified in court to stop Keith from travelling to NJ in 2005 for Thanksgiving because Dr Masel took me to court to stop Keith from leaving were Gary Seale then man who drugged Keith and brought him to TideWay and TideWay's director Sean McCutchen husband to TideWay's attorney Maureen McCutchen.   Gary Seale told the court Keith would never be able to leave TideWay.   For a year and a half I had been visiting Keith and we had spent endless hours together away from the facility away from Galveston without incident.   Client D who was much bigger then Keith who had knock Keith to the floor and ripped his shirt during altercations over the TV was permitted to leave TideWay and visit with his family out of state and all the other clients are free to travel out of state to visit family, go on cruises but not Keith. 

TideWay is a large facility with 20 - 30 clients.    The four corners of the building are assigned a name, Roberts, Stanford, Irwin and Charles house.   Even though this is one building I was told it is regulated as four separate facilities.

2012, 2014 TideWay's flag is always a disgrace.

A few years back clients were no longer permitted to bring leftovers back to the facility.    Reason stated by TideWay was they didn't know how the food was prepared.    Just around the same time TideWay stopped preparing meals for clients.   Meals are now catered.   I was told some times the food gets delivered hours early so then the food needs to be reheated and plated for the clients.   Clients are not given any choice on what to eat.

Below the annual review indicates, "Mr Hanker self initiated Christmas decorations during the Holidays making at least 40 projects which had to be relocated from his room due to limited space."    See the photo of three of the projects.    Keith told me staff was unhappy with him because each client was suppose to get one project.   


Even though Lego's are extremely expensive, I try to buy Keith a Lego set or two every visit to give him something to do but Keith can build them within hours.  The Major problem is TideWay not providing Keith any mental or physical challenging exercises.

"He has accumulated an enormous amount of personal items.   There is so much, that at times, he sleeps on the floor".  

For three days TideWay did nothing to help Keith.    Apparently Keith had been standing waiting at the front door for me for three days.   Below is a letter sent to TideWay's RN.

There were a couple of times when Keith did have his Lego in his bed and slept on floor. 


A frequent reason Keith has to sleep on his floor is from a wet bed.   I have bought numerous plastic liners to protect Keith's bed but staff takes them off  and then Keith's bed gets wet.   During one visit Keith's bed was wet so I asked staff to put a fan in Keith's room to dry it out.   Later that night when we returned to TideWay to put yet another plastic cover on Keith's bed we couldn't because his bed was still drenched...  no fan in room.    TideWay wanted me to buy a new matress.   Keith and I found one but I had no money to buy it for him.   TideWay used Keith's funds and bought him a new mattress but the new matress was immediately ruined because again staff did not put plastic protective cover on bed.   During numerous visits Keith's bed has been soaked.   I bought Keith a portable fan to use to dry out bed.  


Keith's pillows and bed sheets also do vanishing acts.   There have been several times when I visited when Keith was without a pillow and/or bed sheets.

March 2014 calendar of events:

Monday's Stanford House, Tuesday's Charles House, Wed's Irwin House, Thurs's Charles House, Fri's Irwin House.   

Keith resides in Roberts House.     On the 21st and 28 shows meal prep for Roberts House but that doesn't apply to Keith.

All 20 -30 clients sit on a room forced to watch whatever.    Sept 2012 TideWay permitted clients to have tv's in their room but Keith still doesn't have a tv because like everything else I'd be paying the cablefee.   I myself do not have a home phone, cable nor internet so I certainly can't afford to pay for Keith's cable expense.    Even though MNB may or may not reimburse me for this expense, I still would have to pay out of pocket first and wait for reimbursement if Moody National Bank decided this wasn't frivolous, unnecessary or excessive.   Waiting for reimbursement I would also be incurring finance fees too.    I don't recall Keith ever telling me he had any say or a choice of what to watch that is why he spend most of his time sleeping in his room.

Dec 2012 Progress Report by Dr Masel

TideWay scheduled Keith's annual meeting and I requested the date be changed but TideWay thought it was more important for Moody National Bank(Sandy) be at Keith's annual review.

I have bought Keith file cabinets to store the dvd's I had bought him.     Everything is up off the floor and not a tripping hazard as TideWay claims.    What is a tripping hazard is the chairs and equipment extending past the wall outside Keith's room to the common area.    In addition one time a staff member left the mop and bucket for Keith to trip over too.

The restroom is often a mess too!

 "looks can be deceiving or don't judge a book by its cover"  and don't let the price tag fool you either...


Water and mold are an ongoing issue at TideWay.  Keith has been in numerous rooms from one end of the building to the other and in every room there has been a water/mold problem.    Tough to see in the below photo the mold around the edge of the light but worse yet was the reason for the mold around the rim... water would just pour out of the light.   Keith had to move his bed from out under the light and use a can to catch the water.   Second photo is of water seeping through the ceiling.

Keith has been to the Emergency Room twice in 2016.    Instead of staff seeing to it Keith got out of the facility safely during a fire drill, staff rushed Keith causing him to fall permanently damaging his right three fingers.   Keith is right handed.   Now Keith is unable to close his fingers and they are in pain attempting to do so.    Second visit to ER was for severe burns.  


Keith spends a great deal of time sleeping because he is bored.

TideWay facility has only been open for a little over ten years.   Since opening their have been seven directors (Sherry, Sean, Jeremy, Rick, Mark, Stephen, Brian) with long gaps in between directors.   There have been countless employees come and go.   I know of one fatality recently when a client aspirated.   Many years ago I was contacted about a client left off the transport bus hanging on to the outside of the bus being drug along in the street.   


The letter head used by TideWay indicates "rehabilitation" but TideWay is not a rehabilitation facility it is a TBI living facility.

Keith recovered 99.99~ % of his physical mobility shortly after his brain injury accident sixteen years ago.    Recently I had asked Keith if he was getting out for walks and he said no because they were short on staff.   In less then a week, Keith had been to the Urgent Care/Emergency Room twice.    Ongoing issue for twelve years... Keith is unstable as a result of TideWay not providing Keith with proper exercise.    As always TideWay blamed Keith for his three recent falls 2017 in two weeks because of the socks he was wearing.    Keith has been wearing the same style socks, shoes, underwear, shorts and shirts for twelve years while at TideWay.   While socks can be slippery, if Keith was provided proper exercise and wasn’t completely out of shape he wouldn't be so unstable and he would be able to steady himself to stop himself from falling.   It is unknown when or where Keith fell to get the bruise on his left thigh.    The knee happened on Thurs and the face/head occurred the following Tue.  The doctor at Urgent care requested Keith be brought back for a follow up in a few days (Monday) to check his knee but TideWay never took Keith back for a followup and never put Keith on the antibiotic prescribed for the infection in Keith's knee.  

On Tues when TideWay called to tell me about Keith's fall, TideWay staff didn't see any need to take Keith to the ER to have his head checked out.  The welt on Keith's forehead is a direct hit on Keith's brain injury.    No one can tell by looking at someone if their is internal swelling, bruising or a concussion.     I had to request TideWay take Keith to the ER to be checked.
