Moody organizations are not interested in what is best for Keith nor what Keith himself wants. Moody’s have made and will continue to make millions more by forcing Keith to reside in their facility and by controlling Keith’s estate denying Keith HIS Freedom and the use of HIS funds. Moody National bank collects a 5% annual commission fee to manage Keith’s estate. TideWay the Moody owned facility where Keith is forced to reside has been paid over two million dollars not from Keith’s estate but from the State of New Mexico Workmen’s Comp. Keith's estate in Moody National Bank has grown to nearly five million dollars. His estate has a guaranteed annual income of 120k for life and that is excluding the returns from his two million dollar annuity investment and many other investments. Keith is denied the use of HIS money. I am not paid any commission. I have been driven into complete financial ruin providing for Keith yet Moody National Bank has permitted hundreds of thousand of dollars from Keith's estate to be used by other individuals. When all was said and done in Keith's divorce, Moody National Bank saw to it that not only did Keith not get half of the marital assets Keith had been stripped of everything he had ever owned throughout his entire life. Keith was literally left with only the shirt on his back. Keith did not even get his birth certificate, social security card, diplomas or his A&P license... absolutely nothing!
Magnitude of the Moody influence is unimaginable. The Moody's have been in Galveston for generations, are worth billions and known around the world. Getting Keith Legal representation to free Keith from Moody control and to give him access to spend HIS money to go on enjoying life is proving to be quite a challenge. The first lawyer worked for the Moody's. In search for a new lawyer these are a few of the responses I had... a lawyer in Dallas told me if they even thought about going up against the Moody's it would end their career instantly, others stated the Moody's have deep pockets and will drive me into financial ruin/grave, another lawyer stated that even without a valid reason, if I should make it to court to move Keith, the Moody's will have me removed as guardian and turn Keith over to the state of Texas so Keith never leaves.
Two years later I found a lawyer. I paid a five thousand dollar retainer plus more but five years later with a tab of an additional seventy five thousand dollars Keith still at TideWay. Lawyer two passed Keith's case to a third lawyer who signed on to court as representing Keith. Lawyer three was aware the court denied payment for nearly 50K of the 75k legal fees from lawyer two. All legal expenses in regards to moving Keith from Texas were denied by the court. Six months later, lawyer three sends me a letter stating if I want him to represent Keith I have to pay him five thousand dollar retainer and sign a contract stating I am liable for all of Keith's legal expenses. TideWay and Moody National Bank fee's include the cost for their corporations to bankroll legal teams so technically Keith's funds are being used by TideWay and Moody National Bank legal teams to keep Keith against his will and thousands of additional dollars taken from Keith's funds have been paid to TideWay's lawyer and to Moody National Bank lawyers yet zero provisions were established to provide for Keith. In addition to Galveston probate court stripping Keith of his Freedom and me legal guardian of my rights to decide where Keith lives, Galveston probate court judge Kimberly Sullivan has denied Keith the use of HIS own money to pay for a legal team to free him from Moody control and to give him access to spend HIS money to go on enjoying life.
Written words couldn't possibly capture the ugliness and hostility encountered through the past twelve years in my effort to protect my brother nor what Keith has physically and mentally had to endure. While the situation Keith is in has caused this nightmare, Keith waiting at the door for my arrival, always so happy to see and hear from me has given me the strength to endure and in turn I have been Keith's strength. Keith calls me his "powerball". Keith knows I will not quit until he is free. Keith tells everyone there is only two ways for this to end. Either Tracey is six feet under or we have two one way tickets to the northeast.
Keith has been stripped of his freedom and everything he ever owned by Moody organizations. In addition to Moody National Bank denying Keith access and use of HIS money, year after year their has been shortages in Keith's estate by Moody National Bank. While I have reported these shortages to the court in my annual guardianship renewal report, the court has done nothing and Keith's estate continues to be shorted. Keith dedicated his life to serving his country but now Keith is in desperate need of the public's help to free him and his money from Moody control. Without the public's support, Keith will never see another day of freedom.
"Thank you for your service", "We support our Police", "Protect the disabled".... These are all meaningless words.
Keith is desperate for someone to take action to help him so if you value your FREEDOM, please take action to support Keith.

3) Texas Governor Greg Abbott is aware of Keith's horrid situation but will not do anything to help Keith. Please everyone especially residents, voting constituents, of Governor Abbott contact Governor Abbott and request he assist Keith. Also to concentrate awareness since there are sooo many representatives, I am asking everyone to contact the Governor of your home state in the hopes there will be enough voting constituents contacting enough Governors to make Keith’s situation national news.
4) Please don't be a dead end share Keith’s story with your family, friends and co-workers, send Keith's link to your governor, congressman, senator, rich and famous; actors, musician, athletes, news media, etc... ask everyone to continue the chain of sharing Keith's story through social media via tweets, blogs, facebook etc., to help get Keith's story out until Keith has been freed from Moody control.

Keith enlisted in the Air Force after graduating high school. Keith's passion was to fly helicopters so twelve years later he transferred from the Air Force over to Army as a Warrant Officer and became a Huey helicopter pilot. After dedicating over sixteen years in the military, Keith then went on to become a New Mexico State Trooper. Four months after graduating from the Police Academy he was run over by an eighteen wheeler suffering a Traumatic Brain Injury (TBI).
The accident settlement paid 10.9 million dollars: 2.1 million to wife, 2.8 million to New Mexico Workers Comp, 3.2 million to legal, 2.8 million to Keith
Seems simple and reasonable, Keith, a Traumatic Brain Injured survivor wants to be close to family and be permitted to spend HIS money to go on enjoying life. As Keith’s guardian, I should not have to spend days travelling fifteen hundred miles each way to visit and check on Keith. Keith should be within driving distance to myself Keith’s sister/legal guardian, his brother, cousins, aunt and uncle so he can be visited by family anytime in addition to enjoying all our family gatherings for birthdays, holidays and special events but instead because of medical and corporate greed by Moody Organizations for over twelve years Keith has been kept isolated from family in Galveston Texas with no end in sight which is the reason for this plea by Keith asking for the public’s help.
An approved Traumatic Brain Injury facility here in the northeast is ready and waiting for Keith. Keith could be moved tomorrow but needs the public’s support to make it happen. The Moody's with their deep pockets and lawyers will drag this out until Keith dies so he never leaves TideWay.
Keith doesn’t want to be at TideWay and didn’t go their willingly. In Jan 2004, Gary Seale a staff member from TideWay flew to Keith’s home in New Mexico drugged him and took him to TideWay a Traumatic Brain Injury living facility. To ensure Keith wouldn't leave, TideWay's Medical Director Dr Brent E Masel took me to court to stop Keith from travelling home to NJ for Thanksgiving in fall 2005. Not only did Keith not get to travel home for Thanksgiving 2005, in addition the court order states Keith cannot travel past Houston, cannot stay out overnight, cannot leave TideWay without a court order. Dr Masel denies being responsible for stripping Keith of his freedom blaming New Mexico Workers Comp.

I've been visiting and with Keith every step of the way since his accident Oct 2001. I was never contacted about becoming Keith’s guardian instead I received a document from TideWay’s lawyer stating Keith was going to be turned over to the state of Texas. After receiving this document, I hired Bob Shattuck a lawyer from Galveston to get guardianship of Keith in June 2005 when the wife filed for divorce. Bob Shattuck insisted I get guardianship first then worry about moving Keith to the northeast to be close to family. At the guardianship hearing Bob Shattuck requested I be appointed guardian of Keith the “person” and Keith’s estate be put under the guardianship of “Moody National Bank”. Until then I did not know there was guardian of "person" and guardian of "estate". June 2005 I was appointed guardian of Keith and Moody National Bank was appointed guardian of Keith’s estate.
I found a TBI facility here in the northeast to move Keith to in Jan 2007. I kept calling and calling Bob Shattuck stating I wanted Keith moved to the northeast facility. In addition to the guardianship hearing, Bob Shattuck also represented me in Keith's travel hearing.
If not illegal, certainly unethical. Aug 2007 Bob Shattuck stated to me, “I am in a pickle and need to cover my butt. It is a conflict for me because I work for Moody Trust and TideWay will never let Keith leave.” Bob Shattuck was falsely representing Keith. Bob Shattuck worked for Moody National Bank where he put Keith’s estate and he knew TideWay was also owned by the Moody’s.
Learning Bob Shattuck was working on behalf of Moody’s shed a light on reasons why other ongoing issues were not addressed. Most important issue was Keith's well being. TideWay’s medical Director Dr Brent E Masel repeatedly without my knowledge or consent would change Keith’s medications some changes having catastrophic results. Another ongoing issue is Keith not having access and is not permitted by TideWay and Moody National Bank to spend HIS money and denying me reimbursement for items purchased for Keith.
I, Tracey "Keith's Guardian", didn't bring Keith home because of the costly stipulations imposed by the court and then the court denying Keith from using HIS funds to travel and pay for the court required care taker.

So needless to say Brain Injury Association of America isn’t assisting Keith.
It has been twelve years of hostility with Dr Masel repeatedly accusing me of endangering Keith's welfare and trying to remove me as Keith's guardian. Dr Masel had repeatedly put Keith on medications without my knowledge or consent. Please read about Keith's medical issues while at TideWay under the care of Dr Masel. Especially sections in regards to Geodon, Dermatology, Diabetes, Abilify, Artane to get an understanding of the catastrophic health issues resulting from drugs and the overall hostile situation.
It has also been twelve years of hostility by Moody National Bank denying Keith the use of HIS money. Receipts have been sent to Moody National Bank for reimbursement but Moody National Bank denies reimbursement stating items purchased (i.e. eyeglasses, clothing etc. )for Keith are unreasonable, frivolous, excessive, unnecessary and as a result of being denied reimbursement, I, Keith's legal guardian, have been driven into financial ruin because I have been forced to use my personal funds spending every cent of my life saving, retirement and buried in hundreds of thousand dollars of debt providing for Keith. Every visit cost over $2000 out of pocket to pay for travel, Keith's and my meals, outings and any additional items Keith needed/wanted. I am on the verge of losing my home and "my kid's" home. "My kids" are my two donkeys who have lived with me for twenty two of their twenty two plus years of their lives. Even more devastating for both Keith and myself, I have not been to visit Keith since Dec 2016 and as it stands now, I do not have the funds to visit Keith any time in the future.
Please contact Texas Governor Greg Abbott requesting he assist freeing Keith from Moody control.
