Mar 2003 Keith’s 2,828,814.08 million dollar settlement:

$1,000,000.00   million dollars invested into American General Annuity

$1,478,814.08   million dollars invested into MONY annuity

   $350,000.00   cash deposited into account controlled by wife

Total $2,828,814.08 million

Zero funds are used from Keith’s estate to pay the two hundred thousand dollar annual fee charged by TBI facility TideWay.   Keith’s living expenses paid to TideWay is paid for by the State of New Mexico, Workmen’s Comp Risk Management received 2.8 million from Keith’s accident settlement.

Moody National Bank collects a 5% annual fee to manage Keith's estate.   Moody National Bank invests Keith's fund in anything of their choosing hopefully to make the most returns but whether it is five, ten or fifty million in the bank Keith's estate is worthless to him since he is denied the use of HIS money.

One million dollars which was more then one third of Keith's accident settlement was invested in an American General annuity.    According to Beasley, Mitchell annual reports in 2003 and 2004, the American General one million dollar fixed annuity is to pay Keith's estate a 5% annual increase.   According to my calculations the annuity has only been paying Keith's estate 4% annual increase.   If annuity should be paying 5% annual increase then Keith's estate has been shorted over $51149.79 dollars.    Additional shortages documented.   For more information click on link to the right.


Ongoing issue is Moody National Bank incorrect annual reporting to court and shorting Keith's estate.  Missing Trust fund and Workers comp payments.


Over one million dollars was invested in a MONY annuity.   This is a variable flexible spending annuity.    According to Beasley, Mitchell accounting firm funds are invested in numerous companies.   MNB has never submitted any information to the court in regards to the investments, returns or payouts from this annuity.   For more information click on link to the right.


Wife permitted to spend hundreds of thousands of dollars from Keith’s funds;  80k fixing up the house where Keith would never live, bought herself and both adult kids new cars, trip to Europe, Piano….   


Wife kept ALL of Keith's funds from Jan thru June 2005 and did not file an accounting for 2005.   From July thru Dec Moody National Bank only accounted for partial.    Total shortage to Keith's estate for 2005 was 67585.08 dollars.   For more information click on link to the right.

  


MNB divorce settlement on Keith’s behalf.   Not only did Keith not get half of the marital assets from his twenty plus years of marriage Keith was stripped of everything he ever owned throughout his entire life.   Keith was literally left with the shirt on his back.   Keith got absolutely nothing (no birth cert, diplomas, ss card, A&P license… nothing!!!).

MNB deducts Keith’s social security(SS) from travel expenses but does not account for and report to the court as income.     For more information click on link to the right.

MNB denies Keith the use of his funds forcing Keith’s legal guardian to use personal funds to provide for Keith and then denies reimbursement.    For more information click on link to the right.


MNB uses Keith’s funds to pay thousands to TideWay and Moody National Bank lawyers but Keith’s lawyer who has been fighting to stop Keith from being forced on drugs, to protect my guardianship and most important relocate Keith to the northeast was denied payment for nearly 50k of the 70K owed.     For more information click on link to the right.


MNB is deducting money from Keith's estate for a life insurance policy with National Western Life which I believe is a Moody owned company.   I know nothing about the life insurance policy; is it on Keith or ex wife and/or is the beneficiary the ex-wife?     For more information click on link to the right.


MNB large amounts transferred [248K, 362K] to / from principal but no supporting documentation.

Two adult children permitted to use Keith's funds to buy new cars, pay rent, bills and other misc expenses.   For more information click on link to the right.


Questions about investments, returns, no audit trail or supporting documentation.


Five, ten or fifty million dollars in the bank isn't doing Keith any good if he can't spend it.   Keith wants HIS Freedom and the ability to spend HIS money to go on living and enjoying life.


New Mexico Workers Comp payments are not being paid to Keith's estate or not being reported by MNB.

Successor statement from Keith's Trust

A Trust had been created for Keith when the accident settlement was paid.    Although I did not see any provisions within this Trust to provide for Keith, I did notice a successor Trustee clause which states that if the wife "fails or refuses to serve, dies, resigns, is disqualified or is unable to serve due to disability or incapacity,  First Financial Trust Company of Albuquerque, New Mexico, is appointed to serve as Successor Trustee."     To my knowledge the bank in New Mexico did not relinquish their right to manage Keith's estate so how did the Moody's take control?

Keith and I are living proof of the saying.... the rich get richer and the poor get poorer.   Keith has been stripped of his freedom and everything he ever owned and I am on the verge of losing everything I have ever worked for while the Moody's are living the dream getting richer and richer. 


Robert L Moody with American National indicated assets of 20 billion in 2009.   


As of 2014 compensation from National Western Life paid to Robert L Moody Sr 1.9 million and Ross Moody 817k. 

and that's just two Moody owned companies.   

Keith's Accident settlement paid $10,900,000.00 million total:    

The wife received $2,180,000.00  million dollars.   

From the remaining $8,720,000.00 after deducting attorney fees  $3,023,276.59 ,  litigation cost $67,909.33 and  $2,800,000.00 million paid to New Mexico Workmen’s Comp

Keith received  $2,828,814.08
